Harare Hairdresser Sues City Council for US$24K Over Unmarked Drain Accident


A 33-year-old Harare hairdresser, Leocardia Ngonidzashe Mandiwa, has taken legal action against the City of Harare, seeking more than US$24 000 in damages after allegedly falling into an unmarked and uncovered drain in Mabelreign.

The incident occurred on 30 June 2025 near Mabelreign Shopping Centre shortly after Mandiwa had disembarked from a commuter omnibus travelling from Harare’s central business district. Reports indicate that the drain, believed to be حوالي 1.8 metres deep, had no warning signs, barriers, or protective markings, making it difficult to detect.

According to Zimbabwe Lawyers for Human Rights (ZLHR), which is representing Mandiwa through lawyer Tinashe Chinopfukutwa, the local authority failed in its duty of care by leaving the drainage pit exposed and unguarded.

In a statement, ZLHR said the hazard was not reasonably visible, and no precautions had been taken to alert pedestrians. Members of the public reportedly rescued Mandiwa after the fall.

The lawsuit, filed at the Harare Civil Magistrates Court, outlines multiple claims arising from the incident. Mandiwa is demanding a total of US$24 593, including compensation for pain and suffering, permanent disfigurement, future medical expenses, loss of social amenities, medical costs, lost income, and unused rental payments.

She reportedly sustained serious injuries, including multiple broken ribs, and continues to experience ongoing pain. The injuries left her unable to work for six months, from June to December 2025, resulting in lost earnings and disruption to her business operations.

ZLHR argues that the City of Harare’s negligence directly caused the accident and the damages suffered. The case adds to a growing number of lawsuits against the council related to alleged failures in maintaining safe public infrastructure.
