BREAKING NEWS: Madhuku, War Veterans Challenge Constitutional Amendment Bill No. 3 at Con CoCourt
HARARE – Constitutional law expert Lovemore Madhuku has filed an urgent application at the Constitutional Court of Zimbabwe on behalf of six war veterans seeking to block Constitutional Amendment Bill (No. 3).
In the court papers lodged on Monday, the applicants are asking the apex court to declare Cabinet’s approval of the draft constitutional amendment null and void, arguing that the process leading to its adoption was unlawful.
The war veterans are also seeking an interdict barring President Emmerson Mnangagwa from assenting to the Bill pending the court’s determination of the matter.
The application effectively places Constitutional Amendment Bill (No. 3) under judicial scrutiny, with the applicants contending that Cabinet acted outside its constitutional mandate in approving the draft legislation.
If granted, the order would temporarily stop the legislative process and prevent the President from signing the Bill into law until the Constitutional Court rules on the legality of Cabinet’s decision.
Meanwhile, the Speaker of Parliament today gazette the amendment bill starting the 90 day countdown
